Terms of Service
Important: Please read these Terms carefully before using Noema Cognition. By creating an account or using this service, you agree to be bound by these Terms. If you do not agree, do not use Noema.
About Noema — What We Are and What We Are Not
Noema Cognition ("Noema," "we," "us," or "our") is a structured self-reflection and pattern analysis platform. We use AI to help you examine your thoughts, decisions, emotional patterns, and behavioral tendencies — so you can see what is actually happening and what to do next.
Noema is not a medical service, mental health clinic, therapy platform, crisis intervention service, or licensed counseling provider. We are an informational and self-development tool.
Nothing in this service replaces the judgment of a qualified medical or mental health professional. If you are experiencing a clinical condition, psychiatric symptoms, or a personal crisis, please contact a licensed professional immediately.
No Professional Relationship
Using Noema does not create any professional relationship between you and Noema Cognition or its staff. Specifically, no therapist–client, doctor–patient, psychologist–client, counselor–client, or fiduciary relationship is formed by your use of this service.
No licensed mental health professional, physician, psychiatrist, psychologist, or medical practitioner reviews your journal entries, reflections, or AI-generated analysis. Any output you receive is generated by automated systems and is not a substitute for professional evaluation.
AI Output Disclaimer
Noema uses large language models and AI to generate various types of content, including but not limited to:
- Reflective responses to your journal entries
- Pattern analysis and emotional blueprint summaries
- Therapeutic modality suggestions and framework correlations
- Deep Dive prompts and follow-up questions
- Weekly synthesis reports
All AI-generated content is informational and educational only. It is not:
- Clinical advice, diagnosis, or treatment
- A prescription or medical recommendation
- A therapeutic intervention
- A professional opinion of any kind
AI models can produce inaccurate, incomplete, or contextually inappropriate output. You are responsible for evaluating all AI-generated content critically and consulting appropriate professionals before acting on any insights.
Therapeutic modality references (e.g., CBT, IFS, ACT, somatic approaches) are presented as informational frameworks that may correlate with patterns you describe — never as a recommendation that you pursue a specific therapy or treatment. The framing is always correlation and information, not prescription.
Assumption of Risk
Structured self-reflection can surface difficult emotions, memories, and insights. By using Noema, you acknowledge that:
- Introspective work may bring up challenging emotional material, including grief, anxiety, anger, or trauma-adjacent content.
- Noema is not a crisis intervention service and is not equipped to provide real-time support in moments of acute distress.
- You are solely responsible for your emotional wellbeing during and after use of this service.
If you are in crisis or feel unsafe at any point:
If you are feeling overwhelmed, unsafe, or thinking about harming yourself or someone else, please stop using this application and reach out for real-time support:
- In the U.S., call or text 988 — Suicide & Crisis Lifeline
- If in immediate danger, call 911
- Contact a trusted person, licensed mental health professional, or local emergency service
You are not alone, and real-time support is available.
You assume full responsibility for all risks associated with your use of Noema, including any emotional or psychological effects that may result from engaging with self-reflective content.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOEMA COGNITION, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any direct, indirect, incidental, consequential, punitive, or exemplary damages;
- Damages arising from your use of or reliance on AI-generated reflections, pattern analysis, modality suggestions, or any other content produced by the service;
- Decisions, actions, or outcomes you take based on anything generated or presented by Noema;
- Emotional distress, psychological harm, or mental health consequences related to use of the platform;
- Loss of data, interruption of service, or errors in AI output;
- Any harm resulting from your failure to seek professional medical or mental health care.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF NOEMA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHERE JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN SUCH CASES, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO NOEMA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Indemnification
You agree to defend, indemnify, and hold harmless Noema Cognition and its officers, directors, employees, contractors, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the service or violation of these Terms;
- Your violation of any applicable law or the rights of any third party;
- Content you submit to the platform;
- Any reliance you place on AI-generated output from Noema;
- Any decisions or actions you take based on information from the platform.

We collect the following data to operate and improve Noema:

- Usage analytics: Anonymized usage data (page views, session length, feature interactions) collected to improve product quality.
- Billing information: If you subscribe, payment information is handled by our payment processor (Stripe). Noema does not store your full card details.
Voice Journaling Policy: When you use the voice journaling feature, your audio is transmitted to OpenAI's Whisper API for transcription. Audio recordings are never stored by Noema. The audio is transcribed and immediately discarded. Only the resulting text transcript is retained as part of your journal entry.
We do not sell your personal data to third parties. We do not use your journal content to train AI models or for advertising purposes.
You may request deletion of your account and all associated data by contacting us at noema@polsia.app. We will process deletion requests within 30 days.

Governing Law, Disputes & General Provisions
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Noema Cognition — including questions about the scope or validity of this arbitration clause — shall be resolved by final and binding arbitration administered by JAMS (or a mutually agreed arbitration service) under its applicable rules. The arbitration shall be conducted by a single arbitrator and, unless otherwise agreed, shall take place in Delaware or by videoconference. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this clause prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class Action Waiver. YOU AND NOEMA COGNITION AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Noema agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Force Majeure. Noema Cognition is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including without limitation acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, governmental action, labor disputes, internet or telecommunications outages, power failures, or acts of third parties. In such events, our obligations will be suspended for the duration of the force majeure event.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver is effective only if made in writing and signed by Noema Cognition.
Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Noema Cognition with respect to your use of the service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
